The fifth amendment is most commonly known by the phrase, “I plead the fifth,” meaning that individuals cannot be forced to answer questions in court. However, the fifth amendment guarantees a wider range of protections by the national government. For example, procedural due process requires courts to handle cases systematically to ensure a fair trial. Individuals accused of a crime have the right to know the charges against them, hear evidence, and call or cross examine witnesses.
